1) Be affiliated and registered with Social Security (be worker or autonomo)
2) Have completed a minimum contribution period, which varies depending on age:
- If the workers are under 21 years of age on the date of childbirth or on the date of the administrative or judicial decision of foster care or the court ruling establishing the adoption:
No minimum contribution period will be required.
- If the workers are 21 years old or older but under 26 on the date of childbirth or on the date of the administrative or judicial decision of foster care or the court ruling establishing the adoption:
90 days of contributions within the 7 years immediately prior to the start of the leave or, alternatively,
180 days of contributions during their entire working life prior to that date.
- If the workers are 26 years old or older on the date of childbirth or on the date of the administrative or judicial decision of foster care or the court ruling establishing the adoption:
180 days of contributions within the 7 years immediately prior to the start of the leave or, alternatively,
360 days of contributions during their entire working life prior to that date
